A statutory review of the byelaws is required to be carried out every 10 years. A six-week consultation was carried out to find out people’s views on the existing byelaws.

Two thirds of people who responded confirmed they considered the byelaws are still necessary and appropriate.

This was also the position of the Scottish Fire and Rescue Service, while Police Scotland indicated that it would maintain a neutral stance on the byelaws. The NHS Lanarkshire Health Improvement Team response to the survey indicated that no changes were required.

The current byelaws prohibiting the consumption of alcohol in designated public places came into force in South Lanarkshire in March 2010 and were updated in April 2014.

“The existing byelaws remain appropriate and continue to meet the objectives for which they were originally introduced.”
